SMBC日興証券の相場操縦事件をめぐり、証券取引等監視委員会は不正な取り引きがあったと認定し、金融庁に日興証券に対して行政処分を行うよう勧告しました。
SMBC日興証券の相場操縦事件では、特定の銘柄の株価の下落を避けようと不正に買い支えたとして、金融商品取引法違反の相場操縦の罪で、当時の幹部と法人が起訴されました。
監視委員会は、不正な取り引きを防ぐための審査態勢や法令を守るための経営管理態勢が不十分だったと認定し、金融庁に日興証券に対して行政処分を行うよう勧告しました。
また、日興証券が同じグループの三井住友銀行と複数回にわたって顧客に関する非公開情報を共有していた「ファイヤーウォール規制」に違反した事例が3例あったとして法令を守る意識が希薄だったと認定しました。
SMBC日興証券と親会社の三井住友フィナンシャルグループは、「この度の勧告内容を厳粛に受け止め、引き続き、全社をあげて改善・再発防止に取り組み、お客さまをはじめ関係者の方々からの信頼回復に努めてまいります」とコメントしています。
